How Much Are Fees in Dog Bite Cases? Fees in dog bite cases are usually contingent fees. A contingent fee is a fee charged only if the lawyer wins the case. If the case results in a settlment or verdict after a trial, the lawyer is entited to a fee which is usually a percentage of the recovery. The percentage of the fee can be dependent upon factors in the case such as the nature and extent of the bite, factors that relate to the presence of contributory negligence, the ease or difficulty in proving the case and the projected expenses of trial. Contingency fees also provide an incentive a lawyer to work hard in a contingent fee case. Contingent fees are not permitted in certain other types of cases such as child support cases. As long as the fee is reasonble, fees in dog bite cases can also be charged on an hourly basis. In this type of fee arrangment, the lawyer is paid for his time but does not get a percentage of the recovery. All fees in Maryland should be reduced to a written fee agreement.
